Notice-only registry (PLA s11). Registration of a Lien does not constitute Commonwealth verification, approval, or certification of its validity, enforceability, or priority. The burden of proving validity rests solely with the Lienholder; disputes are determined by a court of competent jurisdiction.
Priority (s13). Between perfected Liens on the same Collateral, priority runs first-in-time from the perfection date, subject to the Mechanic's and Purchase Money super-priorities and Tax Lien priority in s13(2).
SIH Agent mirror (s8(4)). The realty plugin's Security Interest Holder Agent system has not yet been certified operational (s35(2)); until certification, all Consensual Liens against Freehold Collateral are perfected by Registry filing, and no plugin assignments exist to mirror.
Erroneous filing? Any adversely affected party may apply for correction or removal; the Department acts within 14 days (s10(2)), appealable to the Federal Court (s10(3)). Knowingly false filings are an offence (Criminal Code, False Lien Filing).
